Step-by-step guide

          If you believe that there is unmistakably unlawful content on a website hosted by us, you can file a complaint with us. We handle complaints on the basis of the Information Communication Technology ICT

            The purpose of the ICT code is to ensure that a report is always handled. This does not mean that the content must always be removed. After all, it may be that a site is mentioned that ultimately does not appear to violate the law.

Who do I have to issue a Notice and Takedown request if I discover illegal or punishable information on the internet?

          Preferably with the person who has placed the information. But that is not always desirable or possible. In that case, the code states that you have to scale up to the organization that is closest to the source. For example, this could be the manager of a web forum or, if unknown, the owner of the website. If it is not known, the person who is hosting the website is looked at. So the closer you are to the source, the better. For each situation, it must be considered who is the next partner in the entire chain. *

The parties are, in order of approach, as follows:

  • First of all, the person or organization that posted the content.
  • Then the administrator of the website.
  • If there is no result, the holder of the domain name.
  • Then you can approach the hosting provider.
  • Finally, you can contact the registrar of the domain name.

          The complainant must motivate the complaint with unambiguous evidence and clarification of having an interest in the complaint. This is best done with the help of screenshots and direct links to content. 

We will then assess the complaint. If we decide that there is no question of unlawful or punishable content, we will inform the notifier of this with a substantiated response. 

If there is unmistakable unlawful or punishable content, then Hensel Hosting must ensure that this content is removed.

If it is not unmistakably clear that the content is unlawful, we will inform our customer of the complaint and request the customer to remove the content or contact the reporter directly. If the complainant and the customer do not come out together, then a court decision must provide a solution. For this the complainant will have to report the offense.
